Aussie mum fights 'harsh' sacking after falling ill with gastro

One young mum has been awarded compensation after she was sacked from her waitressing job, with bosses telling her she or her child were always sick.

Corina Shears was on sick leave from her job at the Angle Vale Tavern in Adelaide, after falling ill with gastro and tonsillitis.

According to the Daily Mail, she received a text from a manager telling her she wouldn’t be needed the next week.

“Hey Corina, hope you are feeling better,” the text read.

“Can I please get your doctor's clearance and we have your shifts covered for next week.”

After questioning why her shifts had been cancelled the following week, she was told by manager Josh Callery she was no longer needed during a phone call.

“He said we are a small team and I am being a liability,” Corina told the Fair Work Commission.

“He then said to me... I now will have more time to be a mum.”

Management at the bistro claim Corina hadn't been fired, but her hours were being cut to help with her health situation – which the mum disputed during the conversation.

“I responded with no, I am not sacking you Corina, you need to take care of your health and yourself so there are no hours at the moment,” Josh told the tribunal.

“She replied with thanks for sacking me. I explained she is not fired and that she needs to take care of her health and we are unable to give her any hours around her restricted availability due to her running her own business.”

Fair Work Commissioner Peter Hampton found the young mum had been unfairly dismissed, ordering that it was “harsh, unjust and unreasonable” and awarding her $2509 in lost wages.
