PEREZ HILTON SAYS MILEY CYRUS CONTROVERSY IS FAKE

The photo showing Miley climbing out of a car, apparently without underwear appeared on Hilton's twitter account with the provocative message "If you are easily offended, do NOT click here ... Oh, Miley! Warning: truly not for the easily offended!"

The tweet and photo were then deleted from his account though it may have already crossed a legal line with implications of child pornography, a federal charge that carries a mandatory sentence of 15 years.

Though Hilton pulled the photo down from his server, it was there long enough for many sites to take screengrabs of it.

Today, the controversial blogger posted a video response on his website addressing the “fake controversy" because the under aged star was actually wearing briefs when she flashed the camera.

"Miley was clearly wearing underwear," Do you think Miley is that stupid to be out in public without panties?"

Hilton also said he would not have posted the picture if the teen was panty-less.

"Do you think I'm stupid enough to post a photo of Miley if she's not wearing any underwear down there?" he said. "Sure I like to be controversial, but I don't want to go to jail."

He said he was simply trying to poke fun at Miley for her lack of grace getting out of the car.

"The reason I linked to that photo is because I thought she was exiting this car in a very un-ladylike fashion," he said, though he has previously nicknamed her "slutty Cyrus" on his site.

Hilton has built his career on being provocative and breaking insider Hollywood gossip but it's possible that his response statement wont be enough this time to save him from incarceration.

He has been down this path before having posted upskirt pictures of Britney Spears previously on his website.

Though Hilton has managed to overcome legal fire in the past (having been involved in copyright and defamation lawsuits over Internet posts before), some are speculating that this time he really could be facing jail.
